These terms govern the WSPR Screening. They apply to curators who run events on it and to anyone who completes a screening through a Screening Link. Using the service means accepting them.
WSPR, we and us mean [ legal entity name — set before deploy ], the operator of the WSPR Screening. The suite means the software operated at screening.wspr.xyz, or any successor domain, and its related pages. A curator is a person granted an account to create events and review screenings. An applicant is a person who completes a screening through a curator's Screening Link. An event is a screening period created by a curator inside the suite. You means whichever of these describes you.
The suite collects structured answers from applicants, scores those answers against a profile the curator has defined, and presents the result to that curator. That is the whole of what it does.
The suite is not an identity verification service, a background check, a criminal records search, a sex offender registry search, a reference check, a safety assessment, a security service, or a consumer report of any kind, and it must not be used as a substitute for any of them. It does not verify that an applicant is who they say they are. It does not determine whether any person is safe, suitable, truthful, or lawful to admit. It expresses no opinion about any applicant's character.
A screening report describes what an applicant answered and how those answers compare with what a curator asked for. It is information for a human decision. It is not a recommendation, a clearance, or a warning.
WSPR is not an organiser, promoter, host, sponsor, venue, or operator of any event screened through the suite, is not a party to any arrangement between a curator and an applicant, and does not attend, supervise, control, or take any part in any event.
You must be at least 18 years old to use the suite in any capacity. By using it you confirm that you are. Accounts are issued by invitation and at our discretion; there is no right to an account and no obligation on us to issue or maintain one.
A curator account is created from a single-use invitation link. You choose your own username and password. You are responsible for keeping your credentials confidential and for everything done through your account. Tell us promptly if you believe your account has been used by somebody else. Accounts are personal and must not be shared, sold, transferred or made available to another person.
Every admission decision is the curator's alone. The suite never accepts an applicant, never declines one, never contacts an applicant, and never communicates a decision. A curator who uses a screening report as an input to their own judgement remains fully and solely responsible for the decision they reach and for everything that follows from it.
As a curator you are solely responsible for: your event and everyone at it; the venue, its condition and its safety; your conduct and your guests' conduct; any harm, loss, injury, dispute or claim arising before, during or after your event; the accuracy of what you tell applicants; your compliance with all laws that apply to you, including those governing your event, your handling of other people's information, and unlawful discrimination; and any tax, licence, permit or insurance your activity requires. WSPR carries none of this and takes none of it on.
A curator receives applicant information for one purpose: deciding admission to the specific event that applicant screened for. As a curator you agree that you will not use it for any other purpose; will not publish, sell, trade, or disclose it to anybody outside the running of that event; will not use it to identify, locate, contact or approach an applicant beyond that event; will not combine it with other sources to build a profile of a person; and will delete or destroy any copy, export or printout you make once the event is over.
If you export, screenshot, print, or otherwise copy applicant information out of the suite, that copy is yours and outside our control. The deletion schedule described in the Privacy Policy applies to what the suite holds. It cannot reach a copy you made. You are the data controller for anything you take out.
You must not use the suite to screen, admit, or process anybody under 18; to facilitate coercion, trafficking, exploitation, or any non-consensual activity; to harass, stalk, threaten, defame, or retaliate against any person; to discriminate against any person on a basis prohibited by applicable law; to gather information for any purpose other than an admission decision for your own event; or for any unlawful purpose.
You must not attempt to discover another curator's room definition or applicants, submit false or automated screenings, probe, scrape, overload or interfere with the suite, reverse engineer it, or resell, sublicense or white-label access to it without our written agreement.
Custom questions you add to an event are yours. You are responsible for their content and their lawfulness, and you must not use them to collect government identification numbers, financial account details, health information, or any other information you have no lawful need for.
Pricing is published on the pricing page and is charged per event, by the length of the screening window chosen. While the suite is in pilot, events are provided free of charge; nothing is billed retrospectively for an event run during the pilot. Where a charge does apply, it is payable when the event is created.
Because an event begins delivering the service as soon as it is created and its Screening Link is issued, fees are non-refundable once an event exists, including where a curator cancels the event, where the event does not take place, and where no applicant screens for it. A curator may cancel an event at any time from within the suite; cancellation immediately stops the Screening Link and deletes that event's screenings and reports, and cannot be undone.
Applicant information is deleted on a schedule fixed when the event is created, as described in the Privacy Policy. That schedule is a property of how the suite is built rather than a setting on an account, and neither a curator nor we can extend it for a particular event or a particular applicant. Deletion is described further, together with its practical limits, in the Privacy Policy.
The suite is provided on an "as is" and "as available" basis. We do not promise that it will be uninterrupted, timely, error-free, or available at any particular moment, and we may change, suspend, or withdraw any part of it. Screening depends on the internet and on third-party infrastructure we do not control. Do not build a plan that fails badly if the suite is unavailable on a given evening.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that any score, archetype, comparison, or written reading is accurate, complete, or predictive of any person's future conduct, or that screening will prevent any incident, harm, or loss. Any reliance you place on the output of the suite is at your own risk.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, revenue, data, goodwill, or opportunity, however caused. We are not liable for the acts or omissions of any curator, any applicant, any guest, or any other third party, or for anything that happens at or in connection with an event.
Our total aggregate liability arising out of or relating to the suite, on any basis, is limited to the greater of the fees you actually paid us in the twelve months before the event giving rise to the claim, or one hundred United States dollars.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
You agree to indemnify and hold harmless WSPR and its operators from any claim, demand, loss, liability, damage, cost, or expense, including reasonable legal fees, arising out of your event, your use of the suite, your handling of applicant information, your breach of these terms, or your violation of any law or of any person's rights.
We may suspend or revoke an account at any time, with or without notice, where we believe these terms have been breached or where we consider it necessary to protect the suite or any person. You may stop using the suite at any time. Sections 5, 6, 11, 12, 13 and 16 survive termination.
We may update these terms. The version identifier at the top of this page changes when we do, and curators are told directly before a material change takes effect. Continuing to use the suite after that means accepting the updated terms.
These terms are governed by the laws of [ jurisdiction — set before deploy ], without regard to conflict of law rules, and the courts of that jurisdiction have exclusive venue over any dispute. Before filing anything, contact us and give us thirty days to resolve it.
Questions about these terms: [ contact address — set before deploy ].
These terms are provided by WSPR as the operator of the suite. They are not legal advice to you, and nothing here changes what the law requires of you where you host.
